Fixed Fee Advice on Finances related to a Divorce

The following fixed fees are available for advice on finances in relation to Divorce / Civil Partnership Dissolution:

No Court Proceedings:

Where a client is the Petitioner and both parties have already reached a financial agreement not to make further claims against the other, without the need to negotiate or issue Court proceedings i.e.: to prepare a Financial remedy Order/Consent Order (often known as a ‘Clean Break’) with a simple clean break ie : no sale or transfer of property, payment of lump sums, maintenance, pension sharing :

This is where both parties have already exchanged financial disclosure on a voluntary basis and have already had an agreement. We will prepare a financial remedy order/Consent Order setting out a ‘clean break’ and submit this to the Court for approval. Cost – £350 plus VAT (total £420) and a Court fee of £50*.

If there are any other provisions or assets to be dealt with that need to be included within the order ie in addition to a clean break there may be sale of property , payment of lump sum, transfer of property , maintenance or pension share then we can usually offer a fixed fee to draft this agreement however you will need to call us on 0115 9247022 or 01332 224570 and speak to one of our family solicitors who will be able to provide you with a quote.

The above fixed fee has to be paid up front unless agreed otherwise.

It is our desire to try and offer a fixed fee service where possible. Any further work based on a fixed fee would have to be discussed with a solicitor at our firm and a quote can then be provided.

There are occasions when fixed fees cannot be offered but we will always try to offer a competitive hourly rate.

The above fixed fees are not available in any of the following circumstances:

(a) We reserve the right to decline to deem that a case is unsuitable for a fixed fee. If we deem it to have complex issues for example, this could include, but is not limited to, where the assets are of a high value, particularly complicated assets or there are assets abroad;

(b) Where documentation has to be served upon the other party;

(c) Where the other party does not respond;

(d) Where the client is eligible for Legal Aid;

(e) Where the other party cannot be located;

(f) This does not include any changes to Court fees or the rates of VAT unless stated ;

(g) This does not include enforcing or defending an Order;

(h) This does not include any hearing or dealing with existing or issued court proceedings;

The above fixed fees have to be paid up front unless agreed otherwise.
