Fixed Fee Advice on Finances related to a Divorce

The following fixed fees are available for advice on finances in relation to Divorce / Civil Partnership Dissolution:

No Court Proceedings:

Where a client is the Petitioner and both parties have reached a financial agreement without the need to issue Court proceedings i.e.: to prepare a Financial remedy Order/Consent Order (often known as a ‘Clean Break’):

This is where both parties have already exchanged financial disclosure on a voluntary basis and have already had an agreement. We will prepare a financial remedy order/Consent Order and submit this to the Court for approval. Cost – £300 plus VAT (total £360) and a Court fee of £50*

Where the client is a Respondent and both parties have reached a financial agreement without the need to issue Court proceedings ie : advising and checking a Consent Order:

This is where both parties have already exchanged financial disclosure on a voluntary basis and already have an agreement. We will check the financial remedy order/Consent Order prepared by the Petitioner’s solicitors and advise about the contents.

We will also assist completing the financial statement accompanying the Consent Order to the court. Cost – £200 plus VAT (total £240) but also you may be asked to contribute half towards the Petitioner’s Consent Court fee £50 i.e.: £25.

Court Proceedings:

Where the client is the Applicant in financial proceedings:

This is where the parties have been unable to reach an agreement on financial matters either between themselves, through solicitors or through mediation. It is where Court proceedings have to be issued. Our work under this fee will include:

a) Issuing the application for the finances at the Court:

b) Preparing your financial statement known as a Form E;

c) Preparing the documents for the first Hearing; and

d) Representing you up to and including at the first Court hearing known as the First Directions Appointment.

This would either be at the Nottingham, Derby, Mansfield, Leicester, Lincoln, Chesterfield or Boston County Court. Our fees – £954 including VAT (£795 plus VAT) plus the Court issue fee of £255.

Where the client is the Respondent in financial proceedings:

This is where the parties have been unable to reach an agreement on financial matters either through themselves, solicitors or mediation. This is where Court proceedings have to be issued. Our work will include:

a) Preparing your financial statement known as a Form E;

b) Preparing the documents required for the first hearing; and

c) Representing you up to and including the first Court hearing, known as the First Directions Appointment at the Nottingham, Derby, Mansfield, Leicester, Lincoln, Chesterfield or Boston County Court.

Our fee is £900 including VAT (£750 plus VAT).

Terms and Conditions of the above Fixed Fees

The above fixed fees are not available in any of the following circumstances:

(a) We reserve the right to decline to deem that a case is unsuitable for a fixed fee. If we deem it to have complex issues for example, this could include, but is not limited to, where the assets are of a high value, particularly complicated assets or there are assets abroad;

(b) Where documentation has to be served upon the other party;

(c) Where the other party does not respond;

(d) Where the client is eligible for Legal Aid;

(e) Where the other party cannot be located;

(f) This does not include any changes to Court fees or the rates of VAT;

(g) This does not include enforcing or defending an Order;

(h) This does not include any hearing that is listed for a time estimate over 30 minutes;

(i) This is strictly limited up to and including the First Directions Appointment and not any further hearing, including an adjourned hearing of the First Directions Appointment.

 

The above fixed fees have to be paid up front unless agreed otherwise.

It is our desire to try and offer a fixed fee service where possible. Even if the work you are seeking is not stated above we will try to offer fixed fees if possible. Any further work based on a fixed fee would have to be discussed with a solicitor at our firm and a quote can then be provided.

There are occasions when fixed fees cannot be offered but we will always try to offer a competitive hourly rate.
